According to the Brazilian Penal Code, those who, due to mental illness – among other factors – are incapable of understanding the illicit nature of their actions at the time of the act, are exempt from penalty. In addition, mental illness can also be a factor in the reduction of one to two thirds of the penalty. Such assertions directly influence the performance of the forensic psychiatrist, criminal expert or not. “Forensic psychiatric practice requires extensive psychiatric knowledge and experience, as well as a solid legal basis”, as stated by the coordinator of the ABP’s Department of Ethics and Legal Psychiatry, Dr. Lisieux Telles, one of the guests of the next program.
