Presidential pardon, psychiatry, society, and justice

Pardon to prisoners is a presidential prerogative according to the Brazilian Constitution, published by decree. In 2008, presidential pardon, previously restricted to convicted criminals, was extended to patients in “safety measure.” Since then, presidential pardon for forensic patients in safety measure has been renewed annually. This situation has generated much debate in the legal and forensic psychiatric setting. In addition, in the few past editions of the presidential pardon decree, the rules for granting this legal institution have been increasingly comprehensive, often lacking technical and legalsupport, which has also led to major discussions and protests from various segments of the society. Therefore, this article aims to present and discuss the controversial aspects contained in the presidential pardon policy, focusing on its application to patients in safety measure, an issue that is directly related to forensic psychiatry.
