The diagnosis of gender dysphoria is made only after a long period, which is characterized by severe psychological distress and functional impairment of the individual at various levels. The health of transgender people depends not only on proper clinical follow-up, but also on a social and political environment that guarantees social tolerance, equal rights and full citizenship. Thepurpose of this report is to offer an update in relation to the diagnosis of gender dysphoria and gender incongruence, as well as to reflect on the difficulties of approaching such individuals, to understand the level of psychological distress and the need for psychiatric expertise, which may assist the judge in confirming the diagnosis of gender dysphoria and also rule out any other diagnosis that could interfere with the patient’s ability to make decisions.
